Terms & Conditions
RECEIVING AND ACCEPTANCE
All nursery stock is shipped at Buyer's risk and expense F.O.B. McMinnville, TN. We charge for packing materials at our cost. Unless given specific instructions, we will ship by the method we think is best. Nursery stock is perishable. All shipments should be immediately and carefully unpacked and inspected on arrival and then placed in proper storage. Any problems with the condition or quality or quantity of goods received should be brought to our attention immediately.
We are very careful to label varieties true to name and will replace, upon proper proof, any that may prove other wise or refund original purchase price. We shall in no case be liable for any sum greater than the amount originally received for said nursery stock. Any dispute arising out of the sale of these goods shall be arbitrated exclusively in the Chancery Court for Warren County, Tennessee, and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Either party not prevailing in such action shall be liable to the prevailing party for responsible attorney fees.
CLAIMS
Claims of any nature must be made promptly upon receipt of stock. We will not honor claims made after 10 days from receipt of stock because we cannot control the care of plants after you receive them. We do not assume responsibility for stock damaged or lost after acceptance by or in transit by common carrier. When damage is apparent, make a claim to your delivering carrier. Please check shipments for damage before signing for receipt.
SHIPPING
We ship by Parcel Post, United Parcel Service (UPS), FedEx, motor freight or truck. All delivery charges, truck load or combination load, are C.O.D. and must be paid when order is delivered. For all other types of shipping, please add your state's percentage (see Shipping and Handling) for packing and shipping deposit. Overpayment will be refunded, underpayment will be invoiced, charged to your credit card, or sent C.O.D.
For all plants that are too large for our shipping boxes we will try to arrange a combination load on a tractor trailer reefer. This is most often less costly and better for the plants.
If there is not enough room for all of your plants when we load your truck, you cannot cancel the balance of your order because we have dug the order special for you.
TO THE TRADE
Prices are based on present market conditions and are subject to change without notice. Prices are in U.S. Funds. All quotations are subject to previous sale and all prices are made for the use of established nurserymen only. This list cancels all previous quotations.
